By accessing or using the Blu Tree Markets website, kiosks, micro-markets, or any related service ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Services.
2. Services
Blu Tree Markets provides AI-powered vending, micro-markets, smart coolers, and related installation, stocking, and maintenance services to commercial venues. All Services are provided subject to a separate site-level service agreement where applicable.
3. Account Registration
Some features (such as the client portal) require an account. You are responsible for keeping your credentials confidential and for all activity under your account. Notify us immediately of any unauthorized use.
4. Acceptable Use
You agree not to misuse the Services, attempt to gain unauthorized access, reverse engineer our equipment or software, interfere with operation, or use the Services for any unlawful purpose.
5. Equipment & Site Conditions
Where Blu Tree Markets installs equipment at your site, you are responsible for providing safe access, appropriate space, and a stable power and network connection as agreed. Title to all equipment remains with Blu Tree Markets unless otherwise stated in writing.
6. Pricing & Payment
Pricing for products sold from kiosks and micro-markets is displayed at the point of sale. End-user transactions are processed by integrated payment providers and subject to their terms.
7. Intellectual Property
All content, branding, designs, and software associated with the Services are owned by Blu Tree Markets or its licensors and are protected by intellectual property laws. You may not copy, modify, or redistribute them without permission.
8. Disclaimers
The Services are provided "as is" without warranties of any kind, express or implied, to the maximum extent permitted by law. We do not warrant that the Services will be uninterrupted or error-free.
9. Limitation of Liability
To the maximum extent permitted by law, Blu Tree Markets will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services.
10. Termination
We may suspend or terminate your access to the Services at any time for breach of these Terms or for any lawful business reason. Site-level agreements govern termination of installed equipment.
11. Changes to These Terms
We may update these Terms from time to time. Material changes will be posted on this page with an updated effective date. Continued use of the Services constitutes acceptance of the updated Terms.
12. Governing Law
These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in Cook County, Illinois.
